Proposed drilling ordinance updated. I see both good progress towards responsible stewardship of our resources, and wide loopholes for the energy companies. I did a quick runthrough of the ordinance last evening (thanks, Linda). I see I need to carve out more time to go item by item. I really do not like the increased use of the ‘Reasonably Prudent Operator’ standard. As this Texas legal document states, “The answer to this question may be similar to Justice Stewart’s definition of pornography ... while you can’t define it, you know it when you see it.” RPO is leaving a ‘standard’ up for interpretation ... not a standard at all. Digging over the internet, I fear RPO may cut against the citizens significantly more than the energy companies. Big Oil likes to use RPO as a legal ramrod.
